Chamnesia Terms Of Service

Welcome to Chamnesia. These Terms of Service ("Terms") govern your access to and use of the Chamnesia messaging application, website, and related services (collectively, the "Service").
By creating a profile, accessing, or using Chamnesia, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
1. About Chamnesia
Chamnesia is a private, invitation-only messaging platform designed to facilitate encrypted communication between individuals and groups.
The Service uses a device-first approach to message storage. Encrypted messages are temporarily relayed through our servers for delivery, while conversation history is stored locally on participating devices rather than maintained as a permanent server-side archive.
2. Eligibility
You must be at least 13 years old, or meet the higher minimum age required by applicable law in your jurisdiction, to use Chamnesia.
By using the Service, you represent that you meet the applicable age requirement and are legally permitted to enter into these Terms.
3. Profiles and Account Security
When using Chamnesia, you agree to:
- Maintain control of your authorized devices.
- Protect any PINs, recovery passwords, or other security credentials you establish.
- Refrain from accessing another person's profile without authorization.
- Notify us if you become aware of unauthorized access or a security issue affecting your account.
You are responsible for activity conducted through your profile, except to the extent otherwise provided by applicable law. We reserve the right to restrict access when reasonably necessary to protect the Service or its users.
4. Invitation-Only Connections
Chamnesia uses invitation codes to establish connections between users. Invitation codes may be temporary, single-use, disabled, or otherwise subject to restrictions.
You agree not to abuse the invitation system, distribute unsolicited invitations, automate invitation attempts, or use the Service to contact, threaten, or harass individuals who do not wish to communicate with you.
5. Acceptable Use
You agree to use Chamnesia lawfully and responsibly. You may not use the Service to:
- Engage in illegal activities or facilitate unlawful conduct.
- Threaten, harass, intimidate, exploit, or impersonate others.
- Distribute malware, malicious links, or other harmful content.
- Send spam, unsolicited bulk messages, or fraudulent communications.
- Share content that violates another person's privacy or intellectual property rights.
- Exploit, abuse, reverse engineer, or interfere with the security or operation of the Service, except as permitted by applicable law.
- Attempt to gain unauthorized access to accounts, devices, servers, or other systems.
- Use automated tools to disrupt the Service or circumvent its access restrictions.
6. Your Content
You retain ownership of the messages, images, and other content you create or share through Chamnesia.
You grant Chamnesia a limited, non-exclusive right to process, transmit, and temporarily relay your content solely as necessary to provide the Service. This does not grant us ownership of your content.
You are responsible for the content you share and for ensuring that you have the necessary rights and permissions to transmit it.
7. Encryption and Privacy
Chamnesia uses end-to-end encryption to protect message contents during transmission. Our servers are designed to relay encrypted delivery instructions without maintaining a permanent archive of delivered conversations.
However, encryption cannot control what another participant does with information after receiving it. Recipients may retain, copy, photograph, capture, or share content outside Chamnesia.
You acknowledge that no messaging service can guarantee absolute privacy, anonymity, or security under every circumstance. Additional information about our data practices is available in our Privacy Policy.
8. Local Storage and Data Loss
Chamnesia stores conversation history, attachments, and certain encryption information locally on your device. Delivered message history is not maintained as a permanent server-side backup.
Consequently, uninstalling the application, removing your local profile, clearing application storage, losing your device, or experiencing device failure may result in the permanent loss of locally stored data.
You acknowledge that Chamnesia may be unable to recover messages, attachments, or other locally stored information that has been lost or deleted.
9. Backups and Profile Restoration
Chamnesia may provide an optional encrypted backup and restoration feature to help you preserve or transfer your profile information.
When using this feature, you are responsible for:
- Creating a backup before removing or transferring your profile.
- Safely storing the exported backup file.
- Safeguarding your recovery password.
- Confirming that your backup file is accessible and usable.
Chamnesia does not retain your recovery password in plaintext and cannot guarantee recovery of an encrypted backup if its password is lost, the file becomes corrupted, or the backup is otherwise unavailable.
10. Removing a Profile and Deleting an Account
Removing a profile from your device deletes its locally stored information from that device. This action does not necessarily delete the associated account information maintained by Chamnesia.
If you wish to request deletion of your account and associated server-side information, you may contact us through our designated support channels.
Deleting your profile or account does not automatically delete messages, images, or other information already delivered to and stored on another participant's device.
11. Service Availability
We aim to provide a reliable messaging service, but Chamnesia may occasionally experience interruptions, maintenance, technical difficulties, or changes in functionality.
We do not guarantee uninterrupted availability, immediate message delivery, or compatibility with every device, operating system, or network. We may modify, suspend, or discontinue features when reasonably necessary, subject to applicable law.
12. Third-Party Services
Chamnesia may rely on third-party infrastructure, application distribution platforms, and other technical services to operate.
If you choose to export or share an encrypted backup through an external storage provider, email service, or another application, your use of that provider is subject to its own terms and privacy practices. Chamnesia is not responsible for services operated independently by third parties.
13. Intellectual Property
Chamnesia, including its name, branding, software, interface, graphics, and other original materials, is owned by Chamnesia or its applicable licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the application for its intended purposes. This license does not transfer ownership of any intellectual property to you.
14. Suspension and Termination
We may suspend, restrict, or terminate access to Chamnesia if we reasonably determine that a user has violated these Terms, created a security risk, engaged in unlawful activity, or materially interfered with the operation of the Service.
We may also take action when required by applicable law or a valid legal obligation. Where appropriate and reasonably practicable, we may provide notice of such action.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Chamnesia is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
We do not warrant that the Service will be error-free, uninterrupted, completely secure, or free from data loss. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Chamnesia and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data, communications, or access.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.
17. Governing Law
These Terms are governed by the laws of Florida, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, legal requirements, or our operating practices.
The effective date at the top of this page will indicate when these Terms were last updated. Where required by law, we will provide additional notice or obtain consent before material changes take effect. Continued use of the Service following the effective date of updated Terms constitutes acceptance where permitted by applicable law.
